These Terms and Conditions set out the terms and conditions applicable to sales between any person purchasing EGIDE products (hereinafter referred to as the Products) via the website Egide-paris.com and EGIDE SAS, a French company registered under number 789 832 169 in the Nantes Trade and Companies Register, with its head office at 13 rue du Coq Gaulois, 77170 Brie-Comte-Robert, France.

Article 1 - Purpose

Any order taken for a product appearing in the online store of the website www.egide-paris.com implies the prior consultation of the present conditions of sale.
The present Conditions of Sale apply only to purchases made via the Online Shop.
We reserve the right to modify these Terms of Sale at any time. The effective date of these Conditions of Sale is indicated below. The Conditions of Sale applicable are those in force on the date the order is placed.
Any product order implies your unreserved acceptance of these terms and conditions.

Article 2 - Prices

The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and exclusive of processing and shipping costs.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of EGIDE. You are entirely responsible for their payment and declaration to the appropriate authorities in your country. We advise you to contact your local authorities for further information.
All orders, whatever their origin, are payable in euros.
EGIDE reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability.
EGIDE reserves the right not to honor an order if the price has suffered a typographical or printing error.
Products remain the property of EGIDE until full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products passes to you.

Article 3 - Orders

Any order placed on the www.egide-paris.com website implies acceptance of these Terms and Conditions of Sale.
Any confirmation of an order implies your full acceptance of these terms and conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation will constitute proof of the transaction.
You declare that you are fully aware of this.
Confirmation of the order will constitute signature and acceptance of the operations carried out.
A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via your order confirmation e-mail address.
EGIDE reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.
The photos representing the products are only indicative and do not enter into the contractual field. EGIDE may therefore deliver to the customer an item slightly different from the one seen by the consumer on the site.

Article 4 - Payment

EGIDE accepts payment by credit card (Carte Bleue, Visa, Mastercard).
In accordance with the French law of March 13, 2000 on electronic signatures, the customer acknowledges that by transmitting his or her credit card information and validating the order, the customer authorizes EGIDE to debit his or her bank account. Products remain the exclusive property of EGIDE until full payment has been received. The order is shipped as soon as the customer's account has been debited in favor of EGIDE. Except in the case of fraudulent use, payment is irrevocable. From the effective date of delivery, the customer is responsible for all risks concerning the product (loss, damage, theft, etc.).

Article 5 - Invoicing

The invoice will be sent to the e-mail address indicated when the order was placed. EGIDE will not be held responsible for any typing errors concerning order information.

Article 6 - Withdrawal

In accordance with the provisions of article L.121-21 of the French Consumer Code, you have a cooling-off period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your decision or pay any penalty.
Returns must be in their original condition and complete (packaging, accessories, instructions). In this case, you are liable. Any damage suffered by the product on this occasion may defeat the right of withdrawal.
Return shipping costs are at the customer's expense. EGIDE will pay for the return of the new exchanged product, within 14 days only.
In the event of exercising the right of withdrawal, EGIDE will reimburse the sums paid, within 14 days of notification of your request and via the same means of payment used at the time of the order.

Article 7 - Complaints

It is the customer's duty to check the condition of the package delivered and to open it in front of the carrier in order to make a claim directly to the carrier if the package has been damaged in transit.
It is also the customer's duty to check the conformity of the product with the order within 48 hours of receiving the product. In the event of non-conformity of the product, the customer must contact the EGIDE customer service department with his/her complaint. After 48 hours, all claims will be rejected. Any return of a product by the customer must be expressly accepted by EGIDE.
Any claim made within 48 hours of receipt of the product by the customer and accepted by EGIDE will result in the return of the new product, the shipping costs of which will be borne by EGIDE.

Article 8 - Availability

Our products are offered as long as they are visible on the www.egide-paris.com website and while stocks last.
If a product is unavailable after you have placed your order, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.

Article 9 - Delivery

Products are delivered to the delivery address indicated during the order process, within the time indicated on the order confirmation page.
In the event of a delay in shipment, an e-mail will be sent to you to inform you of any consequences for the delivery time indicated.
EGIDE may not be held liable for late delivery or failure to perform if the delay or failure results from unforeseeable and insurmountable events, from a third party to the contract or from force majeure.
In the case of delivery by a carrier, EGIDE cannot be held responsible for late delivery due exclusively to the customer's unavailability after several proposed appointments.
Any defect or delay in delivery must be reported by the customer to the EGIDE customer service department within 8 working days of the scheduled delivery date. After 30 working days following validation of the order, the complaint cannot be taken into account.

Article 10 - Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, as provided for in articles L211-4 to L211-3 of the French Consumer Code and 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed.
All claims, requests for exchange or refund must be made by post (13 rue du Coq Gaulois, 77170 Brie-Comte-Robert, France) or by e-mail (contact@egide-paris.com) within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.).

Article 11 - Liability

The products offered comply with current French legislation. EGIDE cannot be held responsible for any failure to comply with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.
Furthermore, EGIDE shall not be held liable for any damage resulting from :

  • misuse of the product purchased,
  • normal wear and tear of the Product(s),
  • transport or storage of the Product(s),
  • improper use of the Product(s) or improper maintenance,
  • failure to comply with the instructions for use and maintenance of the Product(s) as defined in the Product(s) user manual,
  • modification of the Product(s),
  • shock, caused by sharp objects, torsion, compression, falls, abnormal impact and other actions beyond our control.

Finally, EGIDE cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

Article 12 - Applicable law in the event of disputes

These terms and conditions of sale are governed exclusively by French law, without regard to conflict of laws provisions. In the event of litigation, an amicable solution will be preferred before any action before the courts. EGIDE customer service will handle all claims and disputes with the utmost care.
The courts of Paris have exclusive jurisdiction in the event of a dispute.

Article 13 - Intellectual property

EGIDE is the owner of all content published or made available on its website: logo, brand, design, drawings, texts, photographs, illustrations, its own typography.
Any individual or legal entity wishing to reproduce, exploit, rebroadcast or use all or part of the content of this website must request prior authorization from EGIDE.
Any simple link or hypertext link is strictly forbidden without the express written consent of EGIDE.

Article 14 - Personal data

To ensure proper processing of the order, the customer must provide EGIDE with the necessary information. The customer acknowledges having knowledge of this information, which is strictly confidential and may not be communicated to third parties without prior authorization.
In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, modify, rectify, oppose and delete personal data concerning them. Customers may exercise this right by contacting EGIDE via the Internet under the heading contact.
This data is processed electronically, and in accordance with Law no. 78-17 of January 6, 1978, amended by the Law of August 6, 2004, the processing of customer personal data is subject to a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL).
EGIDE reserves the right to collect customer data through the use of cookies in order to improve its personalized service to the Internet user. Subject to customer authorization, EGIDE may send newsletters, commercial, advertising, marketing or promotional offers.

Article 15 - Legal provisions

No modification of the contract by the customer will be accepted unless it has been drawn up, dated and signed by both parties.
The invalidity or inapplicability of one of the clauses of these general terms and conditions of sale shall in no way affect the application or validity of the other clauses of the general terms and conditions of sale. The clause in question will then be replaced by the closest possible provision.
